Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Macro Max mobile application for iPhone (the “App”) and related services provided by Macro Max (“Macro Max,” “we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Macro Max. If you are under 18, you represent that you have permission from a parent or legal guardian.

2. The App and Macro Max Pro

Macro Max provides nutrition tracking, meal logging, AI-assisted food analysis, progress tools, and related wellness features. Some features require an active Macro Max Pro subscription.

Subscription terms:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown in the App.
• Free trials, if offered, convert to a paid subscription unless canceled before the trial ends.
• Manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your iPhone.
• Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

Pricing, trial length, and available plans are displayed in the App at the time of purchase and may change for new subscribers. Apple’s terms also apply to in-app purchases.

3. Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and notify us promptly of unauthorized use at support@macromax.app.

4. Acceptable use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, scrape, or interfere with the App or its systems
• Upload harmful, abusive, or infringing content
• Circumvent subscription, scan limits, or security controls
• Use the App to provide medical treatment or emergency services

5. Health and nutrition disclaimer

Macro Max is for general wellness and informational purposes only. The App does not provide medical advice, diagnosis, or treatment. AI-generated calorie and macro estimates may be inaccurate. Always consult a qualified healthcare professional before making significant changes to your diet, exercise, or health regimen, especially if you have a medical condition, eating disorder, are pregnant, or take medication.

6. Apple Health

If you connect Apple Health, you authorize Macro Max to access only the Health data types you approve. You can revoke access at any time in iOS Settings. Apple Health integrations are subject to Apple’s terms and policies.

7. Intellectual property

The App, including its design, software, text, graphics, and branding, is owned by Macro Max or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. User content

You retain ownership of content you submit (such as meal photos and logs). You grant us a license to host, process, and display that content solely to operate and improve the App, including AI analysis of meal images you submit.

9. Termination

You may stop using the App at any time and delete your account in Settings. We may suspend or terminate access if you violate these Terms or if required for legal, security, or operational reasons. Upon termination, provisions that by their nature should survive will remain in effect.

10. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACRO MAX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Macro Max from claims, damages, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.

13. Changes

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction apply.
